Court fined Xiaomi for showing ads with auto-download links

Recently, Xiaomi has been ordered to pay 1 yuan for the data traffic cost lost due to the automatic download of applications by touching the advertisement as well as charged to stop sending these kinds of ads.

To keep pace with the changing habits of consumers, companies adapt their advertising campaigns by adopting mobile advertising strategies. However, sometimes these ads become really irritating and how Xiaomi made them more annoying is by showing ads of applications that start automatically downloading when touching once.

This angered the customers a lot thus, they filed a case against Xiaomi. And recently, the civil judgment on this product liability dispute between the customer and Xiaomi was released, where the company is sentenced to pay 1 yuan.

Reportedly, the court believed that the act of pushing ads on Xiaomi’s fan did not harm the relevant power and that the disputant could change the settings to avoid advertising interference.

But Xiaomi shows ads that provide click-to-download services. Obtaining the user’s download permission in advance is a violation of their rights to know. The conclusion was that Xiaomi will have to pay compensation to the fan.

To be mentioned, the opponent did not provide direct evidence for their specific losses and costs, based on the infringement circumstances of this case. However, the court judged that the loss claimed by the user 1 yuan should be reasonable, so this claim is supported.
