The information shows that recently, the review decision on the non-registration of multiple trademarks of Xiaomi Technology Co., Ltd. has been published.

Earlier, the opponent Apple proposed that Xiaomi’s No. 20304105A “Xiaomi AIRBOOK” trademark, No. 33495511, No. 33510323, and No. 33491672 “MI App STORE” trademarks and Apple’s “MACBOOK AIR” “APP STORE” and other trademarks are not registered.
If they constitute similar trademarks, they can easily cause confusion and misunderstanding by consumers. After the trial, the State Intellectual Property Office made a decision not to register the above-mentioned trademark of Xiaomi Company. Xiaomi Company refused to accept the decision of the preliminary review and applied for a review.
Moreover, the review found that the opposed trademark and the cited trademark constitute similar trademarks used on the same or similar goods; the evidence submitted by the applicant is not yet sufficient to prove that the opposed trademark can be used for publicity to be comparable to the cited trademarks. Therefore, the reasons for the reexamination proposed by the applicant were untenable, and the opposed trademark was not approved for registration on the reexamined goods.
