Twitter asks Musk to hand over text messages for first six months of 2022: Report

Twitter asked the presiding judge to order that Tesla CEO Elon Musk hand over all communication records since the first half of 2022. Twitter alleges that Musk did not cooperate in exchanging sufficient information before withdrawing from the takeover deal lawsuit.

Twitter submitted the request to Delaware Chancellor Justice Kathalen St.J. McCormick, along with a sealed sanction request against Musk and his lawyers. Court documents show that Twitter wants Judge McCormick to order Musk to turn over all communications from Jan. 1 to July 8, 2022.

At the same time, the company also wants Musk’s senior assistant Jared Birchall to hand over the records of communications during this period. Berchar, who manages Musk’s family fortune, is thought to be deeply involved in his financing related to the Twitter acquisition.

Twitter’s lawyers argued that Musk and his lawyers did not act in “good faith” by showing the records as part of a pretrial exchange of information. Twitter and Musk have subpoenaed more than 100 banks, hedge funds, and individuals to gather testimony for the Oct. 17 trial.

Twitter also said in its request that the company wanted Judge McCormick to order Musk’s legal team to testify in response to questions about its acquisition of Twitter.

On Friday, Musk’s lawyers denied any wrongdoing related to the pretrial exchange of information. They allege that Twitter launched a covert operation to hide witnesses with details on the number of spam and bot accounts on the platform. Musk has challenged the accounts, a core argument for his exit from the deal.

“As Twitter’s efforts to hide information and witnesses have failed, they are now trying to distract people with this gibberish,” Musk’s attorney, Alex Spiro, said in an emailed statement.”
